Town & Country Planning

Introduction

The Department of Town and Country Planning was established in the year 1959 with the main purpose of promoting planned physical development of urban and rural areas taking into consideration the socio-economic aspects. Preparation of Master Plans for the orderly development of Cities, Towns and Villages in the State and providing technical assistance to Urban Development Authorities, Planning Authorities and Local Bodies in the State for implementation of these plans and schemes are the major activites of the Department. The Department is headed by the Director of Town and Country Planning and Joint Director of Town Planning, Deputy Directors of Town Planning and Assistant Directors of Town and Country Planning assist the Director along with supporting technical and administrative staff. It has one Zonal office for Belagavi Division and three divisional offices at Mysuru, Kalaburagi, Bengaluru, Belgavi Zonal office is headed by Additional Director of Town and Country Planning, Dharwad and Mysuru, Bengaluru and Kalaburagi Divisional Offices are headed by the Joint Director of Town and Country Planning of Mysuru, Bengaluru and Kalaburagi respectively. There are 30 branch offices mostly situated at District Headquarters and important towns and they are headed by Assistant Director of Town and Country planning.

Functions

The important functions of the department mainly comprise of :

  • Technical assistance to the Government in formulation of policies and policy guidelines on matters related to urban and regional planning.
  • Technical Assistance to local bodies in preparation of Master plans for urban and rural settlements..
  • Preparation of town and village extension schemes for Urban Local Bodies and local authorities.
  • Preparation of projects related to rehabilitation and resettlement schemes.
  • Technical assistance to various government departments / undertakings in matters related to planning such as furnishing technical opinion to Revenue Department for conversion of agricultural lands for non-agricultural purposes.
  • Technical support to Urban Development Authorities, Planning Authorities, Urban Local Bodies and Local Authorities, in the preparation; enforcement and implementation of Master plans and development schemes.
  • Guidelines for conservation of heritage precincts –Formulation of Heritage Regulations

Activities

Conversion of Agricultural Land to Non-Agricultural Purposes (U/s 95 of the Karnataka Land Revenue Act. 1964)

Application

The owner or the legal entity of the land has to make an application, to the competent Revenue Authority (Tahsildar or the Assistant Commissioner or the Deputy Commissioner, as the case may be, depending on the area to be converted). The revenue authority request the concerned Urban Development Authorities / Municipal planning Authorities / Department of Town and Country Planning for issue of No Objection Certificate or opinion for conversion of land from Agricultural to Non Agricultural Use.

Details required to be furnished with the application are

The following details have to be submitted by the applicant with the application to the concerned revenue authority:

  • Photocopy of the title deed to establish the proof of ownership or bonafide authority over the land.
  • Latest copy of Record of Right and Tenancy Certificate (R.T.C) in original issued by the Revenue Authorities of the Taluk.
  • Certificate of Nil Encumbrance for the land / property issued by the sub-Register having jurisdiction over the area.
  • Photocopy of the Atlas of the land (survey number), duly certified by competent Authority, showing the dimensions in meters and boundary of the land proposed for conversion.
  • Photo copy of the Revenue Survey Map of the village showing location of the land proposed for conversion.
  • photo copy of the receipt for having paid the land revenue (tax) up to date.
  • Challan for having paid the non-refundable fee prescribed for processing of the application.
  • Where proposed conversion is for formation of sites :

Site Plan drawn at scale not smaller than 1:1000, showing the details of existing surrounding developments, cadastral boundaries of surrounding survey numbers and hissas, contours, spot heights, classification of road and its width, developments in the adjoining areas of the proposed land including approach road with width, power transmission line, telephone line, railway line, nearby water reservoirs, nalas, etc. if any.

Procedure

If the land is not situated within the jurisdiction of any Urban Development Authority / planning Authority / Municipal planning Authority constituted under KTCP Act., 1961 which is responsible for regulating the planned developments, then the concerned Revenue Authority after verifying the documents, will forward the application and the copy of documents to

  • Assistant Director of Town and Country Planning, Gadag-Betageri for technical opinion/NOC
  • After verification of the documents as per approved Master Plan, opinion for conversion of land from Agricultural to Non Agricultural use will be given to concerned Revenue Authority.

Issue of Conversion Order

After obtaining NOC/ opinion from all the concerned departments/ Authority, on payment of the prescribed fees, conversion order will be issued by the concerned Revenue Authority to the applicant subject to such conditions as the Revenue Authority may deem fit.

Layout approval

Procedure for approval of Layout /sub-division plan

  • The owner or the legal entity of the land, which has been converted from agriculture to non-agriculture purpose, has to make an application along with relevant documents, to the concerned Local Authority for consideration.
  • The concerned Local Authority after verifying the documents, will forward the application and the copy of documents to the Office of The Assistant Director of Town and Country Planing Gadag-Betageri for technical approval of Layout.
  • On examination of the document, additional clarifications, if any, required, the applicant must furnish the required information or document to the Department.
  • After verification and site inspection if it deems fit, on payment of the required fee, technical approval will be given to the layout plan by the department subject to such conditions as may be specified & also with the condition to release the sites as per the Govt. circular No. ¹Ðƒ… 599 ÀÙÔÚƒ»Ñõ 2012 ¸¹Ñ‘Ð 03-12-2012.
  • In case the sub-division plan needs modifications or revision, the applicant shall make an application with such modifications or revision with relevant documents through Local Authority.

List of documents for Layout approval

  • Sale deed/ partition deed, Latest EC form no-15 and 16,
  • Latest copy of Records of right ( RTC), Copy of Mutation/ Khata certificate & Land acquisition details if any,
  • Original Survey sketch (showing all-round measurements), village map, akarband, duly certified by competent Authority,
  • Site plan prepared using Total Station showing the dimensions of land, contours and surrounding details with in 100 mts. from the edge of the property.
  • Approach road details (viz. classification of Road, width, etc.),
  • Certified copy of Conversion order issued by Revenue Authority,
  • Concept plan (Draft plan prepared as per provisions of approved zonal regulations by applicant),
  • NOC from KSPCB if the area is more than 10.0 Acres.

Fees

Layout Prepartion and Scrutiny Charges Rupees 1250/Hectare. Additional copy of Layout Rupees 100/Shee
